By proceeding to book and attend a remote consultation, the Patient confirms that they have read, understood and fully accept the terms of this Informed Consent.
Clause 1 (Scope and nature of the clinical procedure)
- This Informed Consent applies to the provision of remote clinical services, specifically medical consultations, in accordance with the nature of the service purchased, which are provided within the scope of the activities of Pilar Orgânico – Clínica Médica, Lda., a legal entity with Company Registration Number (NIPC) 519294742, with its registered office at Rua Cândido de Oliveira, no. 15, Ground Floor, Flat, 2825-839 São Pedro da Trafaria, through its Clinical Director Tânia Elisabete Costa Dias Bonifácio, a doctor registered with the Portuguese Medical Association under professional registration number 5000.
- Remote medical consultation is a healthcare service provided by a legally qualified healthcare professional who is registered with the relevant professional body, and is governed by the applicable legal regulations, codes of ethics and good clinical practice currently in force in Portugal.
- The patient acknowledges that this consent applies both to one-off clinical procedures and to recurring clinical procedures, where this arises from the nature of the clinical care agreed.
Clause 2 (Purpose of the remote consultation)
- The purpose of a remote consultation is to carry out a clinical assessment of the patient, gather relevant information, answering queries, providing therapeutic guidance, clinical follow-up and, where clinically indicated, the issuing of prescriptions, reports, medical certificates or other clinically admissible documents by Healthcare Professional Tânia Elisabete Costa Dias Bonifácio, in the course of her clinical practice within the framework of the organisation Pilar Orgânico – Clínica Médica, Lda.
- The patient understands that a remote consultation does not necessarily replace a face-to-face consultation, and that the healthcare professional Tânia Elisabete Costa Dias Bonifácio may, at any time, determine that a face-to-face examination, further tests, or referral to A&E or other healthcare services is medically necessary.
Clause 3 (Limitations and risks of remote service provision)
- The user declares that they are aware of and understand that the provision of remote healthcare has inherent limitations, namely:
- Impossibilidade de realização de exame físico completo;
- Dependence on the quality of the audio and/or video communication;
- Risk of technical faults, connection interruptions or technological limitations;
- The possible need for further information or an in-person assessment to confirm the diagnosis.
- Should healthcare professional Tânia Elisabete Costa Dias Bonifácio consider that these limitations compromise the safety, quality or appropriateness of the clinical assessment, she may interrupt, reschedule or refuse to continue the remote clinical procedure, proposing a suitable alternative.
Clause 4 (User identification and obligations)
- The User undertakes to:
- Provide accurate, complete and up-to-date clinical information, including personal medical history, current medication, allergies, symptoms and relevant test results;
- Properly verify your identity whenever requested;
- Ensure that you are in a private, quiet and suitable environment, safeguarding the confidentiality of the clinical procedure;
- Have the minimum technical resources required to carry out the consultation.
- The user acknowledges that the omission or provision of incorrect information may compromise the clinical assessment and releases the healthcare professional Tânia Elisabete Costa Dias Bonifácio from liability for any consequences arising therefrom.
Clause 5 (Clinical decision and prescription)
- The user expressly acknowledges that:
- The fee for the clinical consultation covers the professional assessment, the time spent on the consultation and the technical expertise of the healthcare professional Tânia Elisabete Costa Dias Bonifácio or another professional appointed by Pilar Orgânico – Clínica Médica, Lda. to provide healthcare services.
- The prescribing of medicines, the issuing of prescriptions, reports, medical certificates or any other clinical documents is determined solely by the healthcare professional’s independent clinical judgement;
- The healthcare professional Tânia Elisabete Costa Dias Bonifácio, or any other designated professional, may refuse to issue a prescription or other documents where this is not clinically indicated, without this constituting a breach of duty, a failure to provide service or grounds for reimbursement.
Clause 6 (Emergencies)
- The user confirms that they are aware that remote medical consultations are not intended for medical emergencies.
- In the event of severe, sudden or life-threatening symptoms, the patient should go immediately to the hospital A&E department or call the national emergency number (112).
Clause 7 (Protection of personal data and health data)
- The patient is informed that their personal data and health data, being sensitive data, will be processed in strict compliance with the General Data Protection Regulation (GDPR) and applicable national legislation by Pilar Orgânico – Clínica Médica, Lda., NIPC 519294742, in the context of the provision of healthcare by its Clinical Director, Tânia Elisabete Costa Dias Bonifácio, or any other healthcare professional.
- The data will be used exclusively for the following purposes:
- Provision of healthcare;
- Administrative management of clinical procedures;
- Communication relating to consultations, appointments, billing and clinical documentation;
- Compliance with the legal and ethical obligations of healthcare professionals.
- You have the right of access, rectification, restriction, objection and other rights provided for by law, and may exercise these rights in accordance with the applicable legal provisions.
Clause 8 (Confidentiality and recordings)
- Healthcare professional Tânia Elisabete Costa Dias Bonifácio, or any other professional practising within the scope of Pilar Orgânico – Clínica Médica, Lda., guarantees the confidentiality of clinical information, in accordance with the law and the relevant code of ethics.
- Consultations are not recorded by the healthcare professional.
- The patient undertakes not to record the consultation, in whole or in part, without the prior, express and written consent of the healthcare professional. Any breach of this obligation may justify the termination of the consultation and possible reporting to the relevant authorities.
Clause 9 (Withdrawal of consent)
- You may withdraw this consent at any time.
Withdrawal does not affect the lawfulness of any clinical procedures or data processing carried out up to that point. - The user acknowledges, however, that withdrawing consent may prevent the provision of future remote medical services.
- The cancellation must be notified in writing or via the channels available on the platform.
Clause 10 (Final declaration of consent)
- By selecting the option “I have read, understood and accept the Informed Consent for the provision of remote clinical services”, the patient freely, knowingly and unequivocally declares that:
- Understands the nature, purpose, benefits, risks and limitations of remote clinical procedures;
- This Informed Consent must be read and interpreted in conjunction with the Terms and Conditions of Purchase for the medical procedure;
- Authorises the provision of healthcare via video call or telephone call;
- You consent to the processing of your personal and health data for the purposes described;
- It accepts that clinical decisions are the sole responsibility of healthcare professionals;
- The medical service is provided by healthcare professional Tânia Elisabete Costa Dias Bonifácio or another designated professional, acting on behalf of Pilar Orgânico – Clínica Médica, Lda., via the technology platform made available for this purpose;
- You acknowledge that this consent is a necessary condition for the performance of the agreed medical procedure.
